BOARD MEETING MINUTES

REGULAR MEETING

A.    CALL TO ORDER/ROLL CALL

Vice President Baskin, in the absence of President Boucke, called the Regular meeting of the Board of Directors of the Stinson Beach County Water District to order on Saturday, December 21, 2019, at 9:30 a.m., at the Stinson Beach County Water District office, located at 3785 Shoreline Highway, Stinson Beach, CA 94970.

The agenda was adopted as set.

D.    GENERAL BUSINESS

  1. Election of Stinson Beach County Water District Board President and Vice President for Calendar Year 2020.
    Director Nelsen nominated Vice President Baskin as the new President and Director Cross as the new Vice President. Director Cross seconded the motion. The motion passed unanimously by President Baskin, Vice President Cross and Director Nelsen.

E.    PUBLIC HEARING

  1. Discussion and possible direction to staff re: a Variance Application to install a new alternative wastewater system at 180 Seadrift Road, James Herbert, Owner, Account No. 6410.
    The purpose of this variance application is to install a new alternative wastewater system for a new single-family residence with less than 3,300 square feet. The existing 1,650 square foot building and wastewater system will be removed or abandoned.

    The new alternative wastewater system is designed for a maximum and average wastewater loading rate of 600 and 400 gallons per day, respectively. The design includes a new 1,500 gallon septic tank, a 1,200 gallon sump tank, 1,500 gallon processing tank, Advantex AX20 recirculating textile pretreatment device, diversion valve, and dual raised dispersal beds. The dispersal beds will be raised 12 inches to meet the three foot vertical separation from seasonal high groundwater.

    A variance is required under Section 4.19.010 Use of Alternative Wastewater Systems Designs to utilize a recirculating textile filter.

    Neighbor notifications were sent timely and a copy of the application had been sent to the Regional Water Quality Control Board. The Wastewater Committee reviewed the application on December 16, 2019.

    Director Nelsen made a motion to adopt draft Resolution No. WW 2019-19 Granting a Variance to the Requirements of the Stinson Beach County Water District Wastewater Treatment Regulations Ordinance No. 2014-04 to Utilize an Alternative Wastewater System for Property Located at 180 Seadrift Road, Stinson Beach. However, this approval is subject to the condition of confirmation from the applicant that the project has been submitted to the County, so that the SBCWD will not become responsible for the environmental review process. Director Cross seconded the motion. The motion passed unanimously by President Baskin, Vice President Cross and Director Nelsen.
  2. Discussion and possible direction to staff re: a Variance Application to install a new alternative wastewater system at 182 Seadrift Road, James Herbert, Owner, Account No. 6420.
    The purpose of this variance application is to install a new alternative wastewater system for a new single-family residence with less than 3,300 square feet. The existing 2,796 square foot building and wastewater system will be removed or abandoned.

    The new alternative wastewater system is designed for a maximum and average wastewater loading rate of 600 and 400 gallons per day, respectively. The design includes a new 1,500 gallon septic tank, a 1,200 gallon sump tank, 1,500 gallon processing tank, Advantex AX20 recirculating textile pretreatment device, diversion valve, and dual raised dispersal beds.     [Note: The project's architect, Steve Wisenbaker, subsequently e-mailed Troy Pearce, the system's designer, on December 23, 2019 a copy of the County's Project Status notification letters for the Herberts' Coastal Permit, Design Review and Variance Applications for the Herbert Residences at 180 and 182 Seadrift, showing that these submissions were made to the County.]

F.    GENERAL BUSINESS

  1. Review of the District's Draft Basic Financial Statements as at June 30, 2019.
    John Cropper and Katy Perry of Cropper Accountancy Corporation discussed the District's recent financial audit for the year ending June 30, 2019. The audit consists of the Independent Auditor's Report, Management's Discussion and Analysis, the Basic Financial Statements, and Required Supplementary Information.

    From their report, Cropper Accountancy Corporation stated, "In our opinion, the financial statements referred to above present fairly, in all material respects, the respective financial position of the business-type activities of each major fund of Stinson Beach County Water District, as of June 30, 2019, and the respective changes in financial position and, where applicable, cash flows thereof for the year then ended in accordance with accounting principles generally accepted in the United States of America."
  2. Discussion and possible direction to staff to grant a Water Use Charge Reduction Request for Mr. and Mrs. Michael Peri, 410 Calle Del Mar, Account No. 506001.
    A Water Use Charge Reduction Request was received on November 12, 2019 and a subsequent addendum was received on November 22, 2019 from Mr. and Mrs. Peri. They are full-time tenants at 410 Calle del Mar. The water use portion of their bill from September 25, 2019 to October 26, 2019 for 29,171 gallons was $481.24. The Peris requested a reduction of their bill due to financial hardship. Mr. Peri became aware of the leak when he noticed water seeping out of the property onto Calle del Mar. Due to Mr. Peri's diligence, he discovered the leak before receiving an e-mail notification from EyeOnWater.

    The District's current Resolution establishing policy for water use charge reductions permits approval for a water use cost reduction under certain circumstances. However, it does not address if a leak is less than 29,920 gallons. The Board carefully reviewed Mr. Peri's appeal and noted his quickness in finding the cause of the leak and subsequent water loss

    The Board determined that relief should be granted in the form of a 50% reduction.

    Director Nelsen moved to grant the Peris a 50% water use charge reduction as well as offering them to pay the remaining $240.62 over a six-month period. Vice President Cross seconded the motion. The motion passed unanimously by President Baskin, Vice President Cross and Director Nelsen.
  3. Discussion re: District Committee Membership by the Board President.
    President Baskin stated that the Wastewater Committee is doing a good job. He appointed the following:

Vice President Cross moved to approve the minutes of November 16, 2019. Director Nelsen seconded the motion. The motion was passed unanimously by President Baskin, Vice President Cross and Director Nelsen.

H.    APPROVAL OF DISBURSEMENTS

Director Nelsen moved to approve the disbursements of November 21, 2019. Vice President Cross seconded the motion. The motion was passed unanimously by President Baskin, Vice President Cross and Director Nelsen.

I.    MANAGER'S REPORT

The General Manager discussed his monthly report. He attended a meeting re: microgrid possibilities for the Stinson Beach Community Center and the District Office and urged the vendor to provide the features, benefits and estimated cost.

Nathan Metcalf of Hanson Bridgett has confirmed that the District can charge Brian Johnson for its legal fees attributable to 21 Calle del Onda. The Board approved donations of $100 each to the Stinson Beach Community Center and the Friends of Bolinas Stinson Beach Libraries.

The Board reviewed the Tiered Usage report and expressed its concern over the high monthly water usage of Andrew Berliner. During the month of November 2019, his water bill showed a usage of 37,829 gallons. He has been requested several times to reduce his water usage.
