BOARD MEETING MINUTES

REGULAR MEETING
Saturday, January 19, 2019

A.    CALL TO ORDER/ROLL CALL

President Boucke called the Regular meeting of the Board of Directors of the Stinson Beach County Water District to order on Saturday, January 19, 2019, at 9:30 a.m., at the Stinson Beach County Water District office, located at 3785 Shoreline Highway, Stinson Beach, CA 94970.

B.    PUBLIC EXPRESSION

Michael Mitchell, Architect, spoke regarding two items: (1) He felt that the statement of record for the Barrel House at 6976 Panoramic Highway, discussed at the Special Board meeting of January 3, 2019, was not complete, and he believed the District could use a little more knowledge and should review his detailed records; (2) The driveway easements from Panoramic Highway shared by the four parties: the Guidis, the Hunts, the Hancocks, and SBCWD as well as a good drainage plan.

On Monday, January 30, 2019, neighbors and District personnel will meet in the field at 10:00 a.m. to observe the current drainage situation and its proposed modifications.

Vice President Baskin noted that a review of Mr. Mitchell's records by the Wastewater Committee would be an efficient means to discuss the substantial history of the project. The Board then set a date for a Wastewater Committee meeting to convene on Monday, March 11, 2019 at 3:00 p.m.

The Board rescheduled the next regular Board meeting to Saturday, March 2, 2019, due to lack of a quorum for the scheduled February 16, 2019 Board meeting.

C.    SETTING OF AGENDA

The agenda was unanimously adopted as set.

D.    PUBLIC HEARING

  1. Discussion and possible direction to staff re: a Variance Application for a new alternative wastewater system at 348 Seadrift Road, Ann W. Skjei Trust, Owner, Account No. 7110.
    The purpose of the application is to replace a failed system which failed a routine inspection on July 12, 2018. The Revocation of Discharge Permit was issued on August 29, 2018. There is no proposed increase of habitable space for this single family residence of approximately 1,456 square feet located on a 16,200 square foot lot. The maximum daily flow rate and average daily flow rate will remain at 300 gallons and 200 gallons, respectively.

    Variances are requested under Section 4.19.010 Use of Alternative Wastewater Systems Designs to utilize a recirculating textile filter and under Section 4.15.100 Site Criteria - Setbacks to eliminate a five foot driveway setback to a raised bed leach field. The septic system will consist of a traffic rated 1,500 gallon septic/process tank, 810 gallon sump tank, recirculating textile filter and dual raised beds. There is over 36 inches of vertical separation from seasonal high groundwater.

    Vice President Baskin made a motion to approve draft Resolution No. WW 2019-01 Granting a Variance to the Requirements of the Stinson Beach County Water District Wastewater Treatment Regulations Ordinance No. 2014-04 to Utilize an Alternative Wastewater System and Allow Parking Over a Raised Bed Leach Field with the following revision to condition "h" and the addition of condition "i ":

    h. The property owner shall maintain and submit a copy thereof to the District of an annual maintenance contract agreement between an approved Service Provider and the current property owner; and
    i. This Resolution shall be recorded by the property owner and proof of recording provided to the District.

    Director Cross seconded the motion. The motion was passed unanimously by President Boucke, Vice President Baskin, and Directors Cross, Nelsen and Zell

E.    GENERAL BUSINESS

  1. Discussion and possible direction to staff to contribute money to the "Stinson Beach National Park Service Support Fund" at the request of Director Cross.
    Local resident Mary Ford has created a GoFundMe Fundraiser to help keep the Stinson Beach Park open during the Federal Government shutdown. The closure of the Park affects the entire community.

    Vice President Baskin and Director Zell both expressed concern over making a gift of public funds to a private person. President Boucke noted that keeping the bathrooms open and the trash picked up benefits everyone. The health and safety of the community are at risk.

    Director Cross made a motion to make a one-time contribution of $500 to the Stinson Beach National Park Service Support Fund to keep public facilities open. Director Nelsen seconded the motion. The motion was passed by President Boucke and Directors Cross, Nelsen and Zell. Vice President Baskin abstained from voting.

F.    APPROVAL OF MINUTES

President Boucke moved to approve the minutes of December 15, 2018. Director Nelsen seconded the motion. The motion was passed unanimously by President Boucke and Directors Cross, Nelsen and Zell. Vice President Baskin was absent at the December 15 meeting.

Vice President Baskin moved to approve the minutes of the Special meeting of January 3, 2019. Director Zell seconded the motion. The motion was passed unanimously by President Boucke, Vice President Baskin and Directors Cross and Zell. Director Nelsen was absent at the January 3 meeting.

G.    APPROVAL OF DISBURSEMENTS

Vice President Baskin moved to approve the disbursements of December 13 and December 19, 2018. Director Cross seconded the motion. The motion was passed unanimously by President Boucke, Vice President Baskin, and Directors Cross, Nelsen and Zell.

H.    MANAGER'S REPORT

The General Manager discussed his monthly report. At the Desalination Committee meeting on January 10, 2019, a decision was made to request $3,000 from the Finance Committee for the cost of submitting a grant application to the California Department of Water Resources for a feasibility study. The Finance Committee approved this request and it will be added to the District's budget.

On Tuesday, January 29, 2019, Director Cross and Vice President Baskin will accompany the General Manager to attend a meeting of the JPIA Board of Directors to discuss the District's experience with River Watch. Vice President Baskin noted that JPIA has a duty to defend the District.

On Monday, February 11, 2019, Director Cross and the General Manager will be attending a meeting of the Marin County Planning Commission to discuss the District's appeal to repeal the Coastal Development Permit to allow the barrel house to be converted into an accessory dwelling unit.

The Board reviewed the correspondence.

K.    CLOSED DOOR SESSION

The meeting was adjourned to Closed Door Session at 10:52 a.m.

L.    OPEN DOOR SESSION

Out of Closed Door Session at 11:45 a.m. The Board convened in closed session to confer with legal counsel for anticipated litigation, significant exposure to litigation, pursuant to California Government Code Section 54956.9(d)(2) for one case. No action was taken.

M.    ADJOURNMENT

The meeting was adjourned. The next regular meeting will be on Saturday, March 2, 2019, at 9:30 a.m.
