A. CALL TO ORDER/ROLL CALL
President Boucke called the Special meeting of the Board of Directors of the Stinson Beach
County Water District to order on Thursday, January 3, 2019, at 9:00 a.m., at the Stinson Beach
County Water District office, located at 3785 Shoreline Highway, Stinson Beach, CA 94970.

Discussion and possible direction to staff re: a possible appeal of the Marin County
Planning Division's decision on the status of the Barrel House at 6976 Panoramic
Highway, Barbara Hancock, Owner, Account No. 3937.
On September 24, 2015, the Marin County Deputy Zoning Administrator (DZA) approved a Coastal Permit authorizing construction of a new 3,651 square foot single family residence, which included an attached 528 square foot garage, in addition to new site improvements including a rear patio and terrace, a new septic system, and landscaping. The existing 540 square foot "barrel house", located in the central portion of the property, was proposed to remain as storage. Condition of approval 2.c stated:
"The Building Permit plans shall reflect that the "barrel house" septic system is being decommissioned and that any kitchen and bathroom facilities in the "barrel house" are being removed."
The applicant wanted to amend the previously approved Coastal Permit to legalize the conversion of the "barrel house" to an accessory dwelling unit that is connected to the existing septic system by an existing septic pipe. The existing barrel house structure was constructed legally, is 17.5 feet in height above grade, and is located more than 100 feet from all property lines.
The Board reviewed numerous correspondence from the District to the County dating back to 2009 concerning the decommission of the barrel house's septic system. Vice President Baskin stated emphatically, however, that this Special Board meeting is not a hearing on a septic system. This public hearing is being held to determine whether or not the Board should appeal the Planning Division's Administrative Coastal Decision regarding the Hancock Coastal Permit Amendment of December 20, 2018. The Board is concerned that the wording of the Administrative Coastal Decision as stated encroaches upon the Stinson Beach County Water District's sole jurisdiction relating to approving septic issues in Stinson Beach.
Sean Kennings, planner of LAK Associates, Michael Mitchell, Architect, Lina Scott and Shawn Scott, Owners, and Sandra Guidi, neighboring property owner, attended the Special Board meeting. Mr. Kennings stated that the District's appeal would cost both time and money. Mr. Mitchell expressed his wish to proceed in the correct manner that would be satisfactory to the District. Ms. Scott wondered what they did wrong, as she did everything she was advised to do.
Vice President Baskin made a motion for the Board of Directors of the Stinson Beach County Water District to appeal the Marin County Deputy Zoning Administrator's decision and Coastal Permit amendment of December 20, 2018 regarding the Hancock barrel house at 6976 Panoramic Highway. Director Cross seconded the motion. The motion was passed unanimously by President Boucke, Vice President Baskin, and Directors Cross and Zell.
The basis of the appeal will be as follows:
1. The Stinson Beach County Water District appeals the decision of the December 20, 2018 Amendment to modify the Hancock Coastal Permit to legalize the conversion of the "barrel house" to an accessory dwelling unit and reconnect it to the existing septic system.
The Stinson Beach County Water District is concerned about the Zoning Administrator's comments on Page 4, paragraph B. Septic Systems Standards. Septic issues are the sole jurisdiction of the Stinson Beach County Water District and as such should not be an item of approval by the Planning Division.
The application for the barrel house's septic system must be submitted to the Stinson Beach County Water District for approval.
2. The Stinson Beach County Water District should be listed as a service provider under "ACTION" on Page 6.
3. SPECIAL CONDITION #10 on Page 3 states that before issuance of a building permit, applicant needs a permit from the Regional Water Quality Control Board. It should state instead that the applicant needs a permit from the Stinson Beach County Water District.
